EXO Terms of Service

These Terms of Service form a click-through accession agreement between you and EXO Contact. By registering, buying minutes, or otherwise using EXO, you confirm that you have read, understood, and fully accepted these Terms and the EXO Privacy Notice. If you do not agree with any part of these Terms, do not use EXO.

1. Service description

EXO is a digital self-reflection service that uses AI-generated voice and text interfaces to support self-observation, structured reflection, and recognition of emotional patterns through a calm structure inspired by CBT approaches. EXO is an information technology product, not a medical service.

2. User age and legal capacity

EXO is intended only for people aged 18 or older who have full legal capacity under applicable law. By registering with EXO, you expressly confirm and warrant that you are at least 18 years old.

Use of EXO by minors is prohibited. If we learn that an account has been created or used by a minor, we may immediately suspend or delete that account and related data.

3. EXO is not therapy, medical care, or emergency support

EXO is not psychotherapy, psychiatry, psychological treatment, medical care, diagnosis, crisis intervention, emergency response, or licensed mental health advice. AI outputs from EXO are informational and reflective only.

If you are in crisis, thinking about harming yourself or others, or in immediate danger, stop using EXO and seek human help immediately.

  • call local emergency services;
  • contact a crisis hotline or the nearest medical provider;
  • tell a trusted person that you need immediate support.

4. Right to use and prohibited behavior

You may use EXO only for lawful, personal, and non-commercial purposes. You agree not to use the service for fraud, hacking attempts, scraping, impersonation, unlawful content uploads, or critical medical, legal, or financial decisions based only on EXO responses.

5. AI limitations

EXO uses AI-generated voice and text outputs that may be inaccurate, incomplete, outdated, repetitive, inappropriate, or misleading. You are solely responsible for evaluating any AI output before relying on it.

6. Voice data and conversation recording

Using EXO voice features involves recording, transmitting, and processing your voice in order to recognize speech and generate replies. By using voice mode, you expressly consent to that processing under the Privacy Notice.

You may not use EXO to record or process the voice of third parties without their separate consent.

7. Memory modes, privacy, and data

EXO may offer different data-retention modes. If you choose a mode that stores conversation history, summaries, transcripts, or continuity data, you consent to the processing and storage of that information as described in the Privacy Notice.

Even in lower-retention modes, technical logs, payment records, security traces, and other operational artifacts may still be stored where reasonably necessary for service operation or legal compliance.

8. Data subject rights

Under applicable data-protection law, you may have rights to access information about processing, request correction, withdraw consent, request deletion, and submit complaints to a competent supervisory authority.

9. Third-party services and data transfers

EXO relies on third-party providers, including AI and voice technology vendors, hosting, authentication, analytics, and payment processors. Your data may therefore be transmitted to and processed by those third parties, including on servers located outside Ukraine.

10. Intellectual property rights

All rights to EXO, including software, trademarks, design, system prompts, databases, and other intellectual property, belong to the Operator or its licensors. These Terms do not transfer any ownership rights in the service to you.

11. Payment, pricing, and refunds

EXO is sold in conversation-minute packages at the prices displayed on exo.contact. Prices may change over time, but price changes do not affect packages already paid for and not yet used, unless otherwise required by law.

You may have a statutory right to withdraw from a digital-service agreement within 14 days after payment if performance has not started yet. If you expressly request immediate supply and start using the purchased minutes, the withdrawal right may be lost for the already supplied part of the service, and refunds may remain available only for the unused balance where required by law.

12. Suspension and termination of access

The Operator may suspend, restrict, or terminate your access to EXO where reasonably necessary for service security, fraud prevention, legal compliance, billing issues, technical provider limitations, or protection of EXO, other users, or third parties.

13. Data deletion

You may request deletion of your account and related personal data at any time. Some information may still remain for a limited period in backups, security logs, accounting records, or tax records where required by law.

14. Disclaimer of warranties

To the fullest extent permitted by law, EXO is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of accuracy, uninterrupted operation, or fitness for a particular purpose.

15. Limitation of liability

To the fullest extent permitted by law, the Operator is not liable for indirect, incidental, or consequential damages, lost profit, or non-material harm arising from use of EXO. The Operator’s aggregate liability for EXO-related claims is limited to the amount you actually paid to the Operator during the 12 months preceding the event giving rise to the claim, unless mandatory law provides otherwise.

16. Indemnification

You are responsible for the content you submit, the decisions you make based on EXO outputs, and your compliance with applicable law while using EXO. To the extent permitted by law, you agree to indemnify the Operator for documented losses caused by your violation of these Terms or unlawful use of the service.

17. Force majeure

The Operator is not liable for failure or delay in performance caused by force majeure events, including war, air-raid alerts, power or connectivity outages, cyberattacks, and other circumstances beyond reasonable control that are recognized under applicable law.

18. Governing law and dispute resolution

These Terms are governed by the laws of Ukraine. The parties will use reasonable efforts to resolve disputes through negotiation. If no agreement is reached, the dispute may be submitted to a competent court of Ukraine unless mandatory law provides another forum.

19. Changes to these Terms

The Operator may update these Terms from time to time. We will give advance notice of material changes where required. Continued use of EXO after the effective date of updated Terms means you accept them.

20. Miscellaneous

If any provision of these Terms is found invalid, the remaining provisions remain in full force. These Terms together with the Privacy Notice form the complete agreement between you and the Operator regarding EXO.
