1. Overview
These Terms of Service (“Terms”) govern your access to and use of EXO, a digital self-reflection service operated by EXO operator. EXO uses AI voice and language interfaces to support self-observation, reflection, and emotional pattern recognition. By accessing or using EXO, you agree to these Terms and the EXO Privacy Notice.
2. Not therapy, not medical care, not emergency support
EXO is a digital self-reflection product, not psychotherapy, psychiatry, medical treatment, diagnosis, crisis intervention, emergency response, or professional mental health advice. Nothing in EXO should be treated as a substitute for licensed professional care. If you may harm yourself or others, or if you are in immediate danger, do not use EXO for urgent support.
3. Eligibility and responsible use
You may use EXO only if you can lawfully enter into these Terms. You agree not to use the service for unlawful, abusive, fraudulent, manipulative, infringing, or harmful purposes, including attempting to reverse engineer, overload, scrape, compromise, or misuse the service or any third-party voice or AI systems integrated with it.
4. AI limitations
EXO uses AI-generated voice and language outputs. Outputs may be inaccurate, incomplete, delayed, repetitive, inappropriate, misleading, or unhelpful. You are solely responsible for evaluating any output before relying on it. EXO does not guarantee that outputs are correct, safe, therapeutic, or suitable for your circumstances.
5. Memory modes and user choice
EXO may offer privacy and memory settings. If you select a mode that stores conversation memory, summaries, instructions, transcripts, or continuity data, you authorize EXO to process and retain such information as described in the Privacy Notice. If you choose a lower-retention mode, operational logs, billing records, security records, and temporary processing artifacts may still exist where reasonably necessary.
6. Third-party services and transfers
EXO relies on third-party providers, including AI and voice systems, hosting, authentication, analytics, and payment providers. Your use of EXO may therefore involve the transmission, processing, and storage of data by third parties, including outside your country of residence.
7. Security and risk allocation
We use safeguards intended to protect EXO, but no online service is perfectly secure or always available. You acknowledge and accept the risks of outages, unauthorized access, interception, hacking, data corruption, malware, and failures involving us or third-party infrastructure. To the fullest extent permitted by applicable law, you use EXO at your own risk.
8. Payments, balances, and service changes
Paid features, minutes, balances, and pricing may change over time. Unless otherwise required by law or explicitly stated by us, purchases are non-refundable once credited or consumed. We may change, suspend, limit, or discontinue features, plans, providers, or integrations at any time.
9. Suspension and termination
We may suspend, restrict, or terminate access where we reasonably believe it is necessary for security, abuse prevention, legal compliance, billing issues, provider restrictions, or protection of EXO, other users, or third parties.
10. Disclaimer of warranties
To the fullest extent permitted by applicable law, EXO is provided “as is” and “as available”, without warranties of any kind, express or implied, including any warranties of accuracy, fitness for a particular purpose, non-infringement, merchantability, availability, security, or uninterrupted operation.
11. Limitation of liability
To the fullest extent permitted by applicable law, EXO and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, goodwill, data, opportunities, or emotional distress, arising out of or related to your use of the service, even if advised of the possibility of such damages.
To the fullest extent permitted by applicable law, the aggregate liability of EXO and its operator for claims arising out of or relating to the service will not exceed the greater of (a) the amount you paid to EXO in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD 100).
12. Your responsibility and indemnity
You are responsible for the content you submit, the choices you make based on EXO outputs, and your compliance with applicable law. To the extent permitted by law, you agree to indemnify and hold harmless EXO and its operator from third-party claims arising from your misuse of the service, unlawful conduct, infringement, or violation of these Terms.
13. Deletion requests
EXO may offer account deletion or “Forget me” controls. Such controls are intended to remove current server-side data linked to your account in EXO systems, but may not immediately remove data from backups, logs, legal archives, fraud-prevention records, or third-party systems where retention is reasonably necessary or legally required.
14. Changes to these Terms
We may update these Terms from time to time. Continued use of EXO after an update means you accept the updated Terms, to the extent allowed by applicable law.
